If you have full coverage on your car, your insurance company will pay for the damages (you'll pay your deductible) and they'll go after the person who was at fault. If they collect any money from the at-fault party, you may be able to recover your deductible. If you don't have full coverage, you can take the at-fault party to small claims court. Just because they dont have insurance doesn't relieve them of their liability.
