FiLife Healthcare Advice Sweepstakes Rules For Twitter
NO PURCHASE NECESSARY TO ENTER OR WIN. PURCHASE WILL NOT IMPROVE YOUR CHANCES OF WINNING.
1. Eligibility. Open to legal residents of the 50 United States and the District of Columbia, who are at least 18 years of age as of September 1, 2009 and have a legitimate Twitter account. Employees, officers and directors of FiLife.com and DJ IAC Online Ventures, LLC ("Sweepstakes Administrators" or “FiLife”), Twitter.com, prize donors, affiliated and subsidiary companies (including but not limited to IAC/Interactive Corp. and Dow Jones & Company, Inc.), their respective advertising and promotion agencies, judges and legal advisors, and the immediate family (parent, child, sibling and spouse of each) or members of the households of such employees, officers and directors are not eligible.
2. Entry Period. Sweepstakes period begins on September 9th, 2009 at 12:00 a.m. Eastern Time (ET), and ends on September 16th, 2009 at 11:59:59 p.m. ET (the " Entry Period").
3. Limitation on Liability. By entering this Sweepstakes, entrants agree to be bound by these Official Rules and that the decisions of Sweepstakes Administrator are final and binding in all respects and agree to release the Sponsors and Administrators and their employees, officers, agents and directors (the Sponsors and Sweepstakes Administrator) and such others, collectively the “Released Parties “), from any and all liability for injuries, losses or damages of any kind resulting from participation in this Sweepstakes and/or use or acceptance of any prize. Any and all claims, judgments and awards shall be limited to actual out of pocket costs incurred, but in no event attorney’s fees, court costs and no punitive, incidental, special, consequential or other damages, including without limitation lost profits may be awarded (“collectively, “Special Damages”), and entrant hereby waives all rights to claim Special Damages and all right to have such damages multiplied or increased.
4. How To Enter. To enter the Sweepstakes go to http://www.filife.com/l/healthcare during the Entry Period and type your three (3) word healthcare advice into the box provided; then hit the “Tweet it!” button. This will automatically post your healthcare advice onto your Twitter account and enter you into the Sweepstakes. You can provide us with as many different three word healthcare advice entries as you wish during the Entry Period and each time you Tweet a different three word piece of healthcare advice you are automatically entered into the Sweepstakes; however entries using automated tweets, will be disqualified. Entries must be sent by a tweet from your own Twitter account by sending out your answer to Twitter on http://www.filife.com/l/healthcare. Profanity and inappropriate content will disqualify the entries and the entrant. Entries must comply with the FiLife terms of use and Twitter terms of use. Any other attempt at Internet or email entry is void.
No responsibility is assumed for lost, late, incomplete, stolen, misdirected, illegible or postage due entries, email or mail; or for any computer, telephone, cable, network, satellite, electronic or Internet hardware or software malfunctions, or unauthorized human intervention, or the incorrect or inaccurate capture of entry or other information, or the failure to capture any such information. Entrants may not enter with multiple email addresses, multiple Twitter accounts and/or multiple identities. Any entrant who attempts to participate with multiple email, multiple Twitter accounts and/or multiple identities or uses any device or artifice may be disqualified.
4. Winner Selection/Odds. Five (5) prize winners will be randomly selected in a drawing on or about September 16, 2009, from all eligible entries received by Sweepstakes Administrator during the Entry Period. The potential winners will be notified by direct message on Twitter. In some instances, a winner will be required to acknowledge, execute and/or return the Affidavit and Releases before a prize will be awarded. Failure to claim a prize or provide prize delivery information within seventy-two (72) hours of the date on which the prize is awarded may result in forfeiture of the prize. Failure to return documents timely, or if prize notification or prize is returned as non-deliverable, or if Winner is found not to be in compliance with these Official Rules or otherwise ineligible, may result in disqualification with an alternate Winner selected. Sweepstakes Administrator’s decisions are final and binding in all matters related to the Sweepstakes. Limit one prize per entrant or Twitter account. Failure to return any required documentation within 15 days may result in the forfeiture of the prize.
Odds of winning depend on the number of eligible entrants received during the Entry Period.
5. Prizes. Five (5) Prizes: $100.00 in cash. Total Actual Retail Value $500.00. Sweepstakes Administrator reserves the right to change or replace the prize at any time with a prize of equal or greater value. The prize is not transferable, assignable nor redeemable for cash. All Federal, State and Local laws and regulations apply. Winners will be responsible for all Federal, State or other applicable taxes in connection with the receipt of prizes.
6. Advertising/Use of Winner’s name and Information . Except where prohibited by law or regulation, winner’s acceptance of prize will constitute permission for Sweepstakes Administrator, FiLife and other Released Parties to use winner’s name, Twitter username, healthcare advice and statements made by winner for any purpose in relation to or reference of this the Sweepstakes, and its promotion without additional compensation, consideration or consent. Additionally by accepting a prize winner agrees that any Affidavit and/or Releases, and any grant of permission to use the winner's name and other information, as stated above, may be secured by Sweepstakes Administrator electronically, for example but not limited to, by email or by facsimile, and such secured Affidavit and/or Releases and permission will have the same force and effect as if any of them had been secured in a written document which was physically executed by the winner. Where permitted by law, winner agrees to grant to Sweepstakes Administrator, and those acting pursuant to its direction or control (and confirm such grant in writing upon request), the right to print, publish, broadcast and use, worldwide in any media now known or hereafter developed, including but not limited to the world wide web, at any time or times, the winner's name, Twitter screenname, healthcare advice, and other winner generated statements as news or information and for advertising, trade and promotional purposes without additional consideration, and without notification, review or approval.
7. General Conditions. This Sweepstakes is void in Puerto Rico and where prohibited by law, illegible, unintelligible or incomplete entries or responses will be disqualified. The Release Parties are not responsible for technical, network, electronic, computer, hardware or software failures of any kind, including any injury or damage to entrant’s or any other person’s computer related to or resulting from participating in or downloading any materials in the Sweepstakes. The Release Parties are not responsible for incomplete, garbled or delayed internet/e-mail computer entries. In the event that technical or other circumstances compromise this drawing. Sweepstakes Administrator reserves the right to cancel modify or terminate this Sweepstakes and the right but not the obligation, to select winners for prizes from all eligible entries received prior to the cancellation. The Release Parties are not responsible for typographical errors in the Sweepstakes site or these rules. Sweepstakes Administrator reserves the right to share entry information with any other Released Parties. Sweepstakes Administrator reserves the right, at its sole discretion, to disqualify any individual it finds, in its sole discretion, to be tampering with the entry process or the operation of the Sweepstakes or the FiLife Website; to be in violation of the Terms of Service of the FiLife Website; to be acting in violation of these Official Rules; to be acting in a non-sportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. If the Sweepstakes is terminated due to tampering or technical difficulties prior to its expiration date, notice will be posted at http://www.FiLife.com/l/healthcare.
8. CAUTION: ANY ATTEMPT BY A USER OR ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SWEEPSTAKES ADMINISTRATOR RESERVES THE RIGHT TO SEEK DAMAGES AND COSTS (INCLUDING WITHOUT LIMITATION, ATTORNEYS' FEES) FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
9. Disputes. In the event of a dispute as to the identity of a person who has entered online, the entrant will be deemed the authorized account holder of the email address submitted at the time of entry, or the authorized account holder of the Twitter account submitted at time of entry - as determined by FiLife in its discretion. "Authorized account holder" is defined as the natural person who is assigned to an official account by Twitter, or email account assigned by an internet or online service provider or other organization (e.g., business, educational, institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.
10. Governing Law: Entrants agree that the sweepstakes shall be governed by the laws of the State of New York and any and all disputes, claims, issues, questions and causes of action arising out of or connected with the Sweepstakes, the construction, validity, interpretation and enforceability of these Official Rules, or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusivity by state or federal courts situated in Manhattan, New York in accordance with the laws of the State of New York.

THE FILIFE WEBSITE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. SOME JURISDICTIONS MAY NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES OR EXCLUSION OF IMPLIED WARRANTIES SO SOME OF THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU. 12. Official Rules and Winners List. For a copy of these Official Rules, please send a self addressed, stamped envelope to The FiLife Healthcare Advice Sweepstakes for Twitter at 555 West 18th Street, New York, NY 10011. (WA and VT residents only may omit return postage). For a list of prize winners send a self addressed, stamped envelope to the address referenced immediately above. All requests for a list of prize winners and copies of Official Rules must be received by November 1, 2009.
